1.Acceptance of Terms
By accessing or using the website churchlend.com (the "Site"), operated by ChurchLend, a DBA of Hightower Corp Inc. ("ChurchLend," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Site.

ChurchLend provides a free, educational church loan readiness platform that includes:
- A church loan readiness assessment that scores churches on factors lenders evaluate
- Financial calculators for loan payments, debt service coverage, loan-to-value, affordability, refinance savings, and capital campaign planning
- A directory of church lenders including extension funds, credit unions, brokers, and banks
- A searchable database of grants available to churches and houses of worship
- Educational articles, guides, and resources about church financing
- Optional lender matching services to connect churches with financing partners
3.ChurchLend Is Not a Lender
ChurchLend is an educational tool, not a lender. We do not originate, underwrite, fund, or service loans. We do not provide financial advice, investment advice, tax advice, or legal advice. The information provided on our Site is for educational and informational purposes only and should not be construed as professional financial guidance.
Readiness scores, rate estimates, calculator outputs, and any other data generated by our tools are estimates based on general industry benchmarks and the information you provide. They do not constitute a loan offer, pre-approval, commitment to lend, or guarantee of any specific terms or rates.
Actual loan terms, rates, fees, and eligibility are determined solely by the lender based on their own underwriting criteria, your complete financial profile, property appraisal, and other factors not captured by our assessment.
4.User Responsibilities
When using our Site, you agree to:
- Provide accurate and truthful information in assessments, forms, and other submissions
- Use the Site only for lawful purposes related to church financing research
- Not attempt to gain unauthorized access to any part of the Site, our systems, or other users’ data
- Not use automated tools (bots, scrapers) to access or collect data from the Site without our written permission
- Not submit false, misleading, or fraudulent information
- Not use the Site in any way that could damage, disable, or impair our services
5.Intellectual Property
All content on the Site, including text, graphics, logos, images, calculators, assessment tools, scoring algorithms, and software, is the property of ChurchLend or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from our Site without our prior written consent, except for personal, non-commercial use related to evaluating your church’s financing options.
6.Lender Matching and Referrals
When you request to be matched with a lender, we may share your assessment data and contact information with one or more lending partners. By requesting a lender match, you consent to this sharing and understand that:
- We are introducing you to independent third-party lenders over whom we have no control
- Any lending relationship is between you and the lender directly
- We make no guarantees about loan approval, rates, terms, or the quality of service provided by any lender
- We may receive referral compensation from lending partners
- You are not obligated to work with any lender we introduce
7.Disclaimer of Warranties
THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any information, scores, estimates, or recommendations provided through our tools.
8.Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CHURCHLEND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9.Indemnification
You agree to indemnify, defend, and hold harmless ChurchLend and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of any third party.

11.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.
